Area, (Name of State) of Federal Republic of Nigeria
(here-inafter called the “LANDLORD”) of the
one part.
And

Republic of Nigeria (hereinafter called the (“TENANT”) of the other part.
WHEREAS
IT IS AGREED AS FOLLOWS:
1. The landlord let and the tenant agree to
take from him three Bed Room Flat situate at No 30A ……… Street ………. (Name of
State).
2. The Tenancy shall be one (1) year tenancy
both at it’s Commencement and subsequent renewal. Perhaps, the said tenancy shall
be terminable by either party by not less than six (6) months notice in writing
to the other during its renewal.
3. The rent shall be (Amount) per-year.
Perhaps, the landlord shall have power to increase the said rent in the
premises according to prevailing circumstance during the tenancy. However,
before the landlord increase the rent in the premises, he shall first of all,
give six (6) months notice in writing to the tenant of his intention to
increase the rent and the amount to be increased. The said notice is to enable
the tenant make up his/her mind whether to pay the new rent or to vacate within
the stated months period.
4. The tenancy agreement shall commence as
from………….day of …….……….. 20…..
5. Should the tenant default in payment of
his/her rent, the landlord shall terminate the agreement and tenancy by six (6)
months notice as here-instated and further sue for any out standing arrears of
rent due to him.
THE
TENANT HEREBY AGREED WITH THE LANDLORD AS FOLLOWS:
1. To
use the premises for residential purpose only
2. To
pay the rent within one month of expiration of the initial payment and the tenancy.
3. To keep the said three bed room flat/apartment
and premises in tenantable repair during the tenancy and to preserve same from
willful damage.
4. Not to put futures, add or alter the
condition of the three bed room flat without the direct and express consent of
the landlord or his solicitor in writing.
5. Not to interfere with the wall and ceiling,
such as nailing on the wall of the said three bed room flat and premises as to
cause damage to any part of the building.
6. The gate should be locked from 10pm in the night and visitors are
not allowed from 9pm in the
night.
7. To handover key of the apartment to the
landlord or his solicitor when vacating the apartment and its appurtenances.
8. Not to do, permit, cause or suffer to be
done in the said residential premises any act or thing, which shall or may be
an annoyance to the landlord or the occupiers of the adjoining premises and
Co-tenants.
9. To permit the landlord and/or his agent
(solicitor) to enter the said three bed room flat at all reasonable time for
the purpose of viewing the condition thereof.
10. To repair, replace or pay for all the damages
done by her/his agent and or servants in the three Bed Room apartment and
appurtenances.
11. The bore-hole in the premises shall be
internalized for the tenants use only and not for commercial purpose i.e. not
for sale by the tenants.
12.
Not to sublet the said three Bed Room Flat to any other tenant.
13. Not to bring or store petrol or any explosive
any where on the premises.
14. To keep the toilet and any other convenience
in the premises clean.
15. To pay for the electricity consumed in the
premises occupied by the tenant.
16. Each tenant shall provide his or her own
waste container and shall join other tenants in cleaning the gutter and the
whole premises in rotations according to clean up roaster. General clean up of
the whole yard shall be observed on 1st Saturday of every month, followed
by Government last Saturday of the month sanitation. Moreso, toilet and
bathroom must be thoroughly washed and disinfected.
17. To use only tissue and water in the latrine
sewage system, not newspaper e.t.c.
18. Not to add or erect any minor or substantial
structure, improvement and development e.g plantation of trees, construction of
batcher in the demised premises.
19. Not to rear animals e.g goat, cat, sheep,
dog, fowl e.t.c in the said residential premises.
20. Not to tune or play radio, radio-gram or
Television in the premises so as to disturb other occupiers of the premises.
21. To provide fire extinguisher in the kitchen
or any safe place in the premises for use in case of fire outbreak.
22. To contribute together with other tenant the
cost of dislodging septic tanks and soak-away in the premises when filled with
farces.
23. No tenant should display any discriminatory
attitude against follow tenants.
24. No tenant shall use the apartment or convert
the apartment to place of worship, ministry or for religious activities.
25. Every tenant shall maintain peace and embrace
brother hood. There should be no fighting, quarreling, nagging, use of abusive
and insultive words on the follow tenant.
26. No
tenant is allowed to come into the premises with cultist, likewise, no tenant shall be member of
secret society.
THE
LANDLORD HEREBY AGREES WITH THE TENANT AS
FOLLOWS:
That the tenant paying the said rent whenever
it falls due, observing and performing his/her entire obligation under this
tenancy agreement shall quietly hold and enjoy the said residential premises
without any interruption by the landlord or any person rightfully claiming
through or under or in trust for him.
