Some people in some communities have
formed the habit of requesting for unlawful damages caused by companies
(especially oil or quarry companies). They always seize every opportunity to
extort money from unsuspecting companies from different claims. Most companies
a have suffered this fate because of lack of knowledge or ignorance of the
federal or state law guiding the community. A team member of “Martins Library” decided
to write and post an example of a letter to defend these companies. If you are

We write on behalf of (name of company), a company incorporated under part ‘A’ of Company
and Allied Matters Act, 2004 which has its corporate Head Office at (write complete address here)
The letter which you wrote to us demanding for the immediate
compensation of (Mr. A) in (name) Local Government Area and (name) Local Government Area of (name of state) respectively and that
the reasons for your demand were as follows:-
1.
That the blasting
which our company carries out has caused a lot of damages to most of your
houses.
2.
That the horrible
sound produced by the blasting, has in so many times caused heart failure to
many of your people and probably untimely visit to their ancestral home.
3.
That the emitted
fuel and choking smell produced after the blasting as a result of the
explosive, throw people into a feat of coughing and other sicknesses.
In
answer to the critical issues which were raised in your letter addressed to the
manager of (name of company), which
has its branch office situate at Mining Corporation, since (year of in-cooperation) we wish to categorically state as
follows:
That
non of the buildings of the members of the two villages respectively is sited
within the vicinity of the quarrying site and hence, non of the members of the
two villages could rightly claim that his or her buildings was damaged by the
activities of our company. And that our company does not operate illegally, as
it has the license of the Federal Government and has not breached any of its
contractual terms with her host village and community.
In
answer to issue two, we strongly
believe that since the two villages were not located within the site, that the
sound which emanates from the blasting cannot in any way constitute nuisance to
the villages as alleged, and therefore, the villagers cannot validly demand for
compensation when they have not suffered any wrong as a result of the
activities of our company.
In
answer to issue three, we wish to
further affirm that the mining activities of our company is not hazardous to
the two villages since there is nothing whatsoever that connects our company
with the people of (name of the two
villages) except the state/quarry road which everybody is using and that
our company in her flowing charity and milk of human kindness has decided to
accommodate some members of the two villages
by way of employment of the pit operators and loaders etc at the said
site.
It
is also our company’s instruction, that before its operation in the (year of in-cooperation), that it
validly entered into a contract with the people of (name) and its community and has never breached any of their
contracted terms till date, that your frivolous demand for compensation was
merely to extort money from us.
TAKE NOTICE, that any genuine complaints, demand or otherwise by
any affected person(s) villages or community should be directed to the
permanent secretary, Ministry of Commerce, Industry and Mineral Development (name of state) for advice and approval,
as we cannot tolerate any act of intimidation from any quarters.
