HOW TO WRITE A LETTER OF COMPLAINT ON THE REFUSAL TO PAY THE GRATUITY

Dear Sir

LETTER OF COMPLAINT ON THE REFUSAL TO PAY THE GRATUITY OF MR. (NAME OF CLIENT)
We refer to your letters dated 13th June, 2013 and 7th September, 2013 which is our response to your letter dated 21st June, 2013 all in respect to the above subject matter. Copies of all correspondence are attached herewith.

The above attachments speak for themselves and show the effort our client has made to resolve this matter amicably without resorting to litigation. However for avoidance of doubt, permit us to narrate the bare facts again;

(a)     That our client joined the service of your Commission on 25th October, 1979 as an establishment labourer. See the attached letter of employment.

(b)     That evidence of his birth which is statutory declaration of age deposed to on 20th June, 1978, was submitted to your Commission at the time of his employment, which clearly showed that our client was born on 30th day of June, 1950. See attached copy of the said age declaration.

(c)     That owing to error by your Commission our client was wrongfully retried vide your notice of retirement dated 20th June, 2010, which notice backdated his retirement to 1st November, 2007. See the attached copy of the retirement notice.


(d)     Upon our protest over the wrongful and untimely retirement, your Commission responded and gave our client’s date of birth as 1st April, 1947, but every effort we have made to ascertain the source of your information on our client’s date of birth especially vide our letter dated 7th September, 2013 has yielded no positive result.

(e)     In view of the forgoing, we decided to leverage on your Commission advise as contained in paragraph (iv) of your said letter by approaching the Local Government Staff pensions Board for the payment of our client’s gratuity, but we have been told in clear terms that our client over stayed his service period and as such was not entitled to his gratuity.

Sir, it is against this backdrop that we are appealing and insisting that the obvious mistake from your Commission with respect to our client’s date of birth be corrected so as to enable our client to receive his gratuity and exit from your Commission’s employment gracefully. It is certainly an act of injustice in the highest order for our client to forfeit his gratuity after almost (30) thirty years of meritorious service to your Commission on account of your Commission’s error.

We trust that this letter will given expedited attention so as to save our client from suffering unduly.
