This deed of conveyance is made the-------------------- day of -------------2014

BETWEEN

(Name) of (address), (hereinafter referred to as “THE VENDOR” and which expression shall wherever the context so admits, include his heirs, executors, administrators, assigns, successors-in-title and all those lawfully claiming title through or under him) of the first part.


And

(Name) of (address), (hereinafter called “THE VENDEE” and which expression shall wherever the context so admits include their heirs, executors, administrators, assigns and all those lawfully claiming title through or under him) of the second part.

WHEREAS:
1.      By native law and custom of the Izzi people of Ebonyi State, (NAME) father inherited a piece of Land from his father.
2.      In furtherance of this native Law and custom of land inheritance in Izzi land,he also got part of this piece of land vide inheritance  by virtue of his being a male child;
3.   The said land is located, situate and lying at (NAME) in Izzi  L.G.A, Ebonyi LGA, Ebonyi State, and more particularly                  marked and shown verge Red on the survey plan No …………………….; and herein called “the plot”. 
4.      By virtue of the natural ownership of the land, the vendor, (NAME) in accordance with the overriding position of the Land Use Act 1978, now Cap 202 of the Laws of the Federation of Nigeria, 1990, is deemed the holder of the Statutory Right of Occupancy in and over all that property.
5.      The Vendor has not dealt with the said property in any manner preventing him from conveying same to the purchaser in fee simply absolute.  In which case, the vendor as a beneficial and bona-fide owner is vested with absolute authority to sell and convey the said property.

AND WHEREAS the vendor has voluntarily agreed to sell, transfer and perpetually convey the right, interest in and title in/over the property to the vendee ad infinitum and the purchaser has agreed to purchase same at a consideration of (AMOUNT) Forty Four Thousand Naira (N44,000.00) only for example.

NOW THIS DEED OF CONVEYANCE WITNESS AS FOLLOWS: 
That pursuant to this deed of assignment, and in consideration of the sum of the sum of (AMOUNT HERE) Forty Four Thousand Naira (N44,000.00) only FOR EXAMPLE paid fully by the vendee, (which the vendor hereby acknowledges) the vendor as beneficial and bona-fide owner hereby perpetually conveys, absolutely, sells, transfers and demise UNTO the purchaser ad infinitum, the right, estate, interest and title in and over ALL THAT piece and parcel of land known as and lying, being and situate at Agbaenyim Iboko in Izzi Local Government Area of Ebonyi State; which said land is more particularly delineated for identification only and verged RED in   Survey Plan Number ……………………..Attached hereto, prepared by a licensed surveyor …………………………..and having beacon numbers …………………………………………………………………………………………………………………………….. (hereinbefore and after called “The Property”) TO HOLD THE SAME UNTO the purchaser without any encumbrance whatsoever and by whosoever.




The payment of the above sum is further to the performance and observance by the purchaser for the vendor of all traditional and/or customary rites on conveyance of the land as applicable under Mgbalaukwu, Izzi native law and custom (FOR EXAMPLE) for the absolute sell and transfer of land (the fact of which said performance and observance the vendor hereby acknowledges).

PROVIDED ALWAYS AND IT IS HEREBY AGREED that:

1.      The vendor and his estate shall fully indemnify the purchaser with substantial interest against any loss and or damages incurred by the purchaser and arising from or otherwise connected with any defect in or challenge of the title of the vendor in respect of the property or any part thereof.

2.      The purchaser shall at all times ad infinitum have quiet, peaceable and undisturbed enjoyment, possession and ownership of the property without any interruption, let or hindrance and or interference whatsoever from the vendor or any person or persons claiming under, through or in trust for him or whoever.

3.      The vendor shall surrender to the purchaser all the original and other copies of the title deeds and other documents in relation to the property (if any) hereby demised and shall also procure and surrender to the purchaser any other legal document(s) required by the purchaser for the purpose of perfecting his title to the property.

4.      The vendor shall diligently and without any charge assist the purchaser (as and when required) in applying for and obtaining the requisite Governor’s consent to the conveyance hereby made in respect of the property.

The above deed having been first read over and interpreted to the illiterate donor and explained to him in Izzi dialet or Igbo language and he apparently understood it perfectly before affixing his right thumb impression thereon in my presence
